These Terms and Conditions (“Terms”) govern your use of the website at thegadangme.com (the “Site”) and any purchase you make through our shop. The Site is operated by The GaDangme (“we”, “us”, “our”). By placing an order or otherwise using the Site, you agree to these Terms. Please read them carefully. If you do not accept them, please do not use the Site or place an order.
1. About these Terms
These Terms apply to all orders and to your use of the Site. We may update them from time to time; the version in force at the time you place your order is the one that applies to that order. The current version is always the one published on this page.
2. Eligibility
To place an order you must be at least 18 years old and legally able to enter into a contract. By ordering, you confirm that the information you provide is accurate and that you are authorised to use the payment method offered.
3. Products and availability
We aim to describe and picture our products as accurately as possible, but colours, patterns and finishes may vary slightly from what appears on your screen. Where items are handmade or produced in limited quantities, small natural variations are normal and are not defects.
- Fabric sold by the yard. Cloth priced per yard is cut to the length you order. Because it is cut to order, the quantity and total shown at checkout reflect the number of yards selected.
- Pre-orders and backorders. Some items may be offered for pre-order or on backorder before stock arrives. Estimated dispatch times for these items are shown on the product page and are estimates, not guarantees.
- Availability. All products are subject to availability. We may withdraw or change products at any time.
4. Orders and acceptance
When you place an order you will receive an acknowledgement by email. This confirms we have received your order; it does not mean we have accepted it. A binding contract is formed only when we confirm that your order has been dispatched. We reserve the right to decline or cancel an order, for example if an item is unavailable, if there is an error in the price or description, or if we are unable to fulfil delivery to your location. If we cancel an order you have already paid for, we will refund you in full.
5. Prices and payment
Prices are shown in pounds sterling (GBP). We try to ensure all prices are accurate, but if we discover an error in the price of an item you have ordered we will contact you before dispatch so you can choose to continue at the correct price or cancel. Payment is taken through the payment methods offered at checkout. You must be authorised to use the payment method you choose.
6. Shipping and delivery
We currently ship to selected destinations, including the United Kingdom, Europe and the United States. Available destinations, delivery methods and shipping costs are shown at checkout. Some shipping charges are based on the weight of your order, and any weight-related surcharge is shown before you pay. Delivery timescales are estimates and are not guaranteed. Risk in the goods passes to you on delivery. You are responsible for any import duties, taxes or customs charges that may apply in the destination country.
7. Returns, refunds and cancellations
Your rights to return items and receive a refund are set out in our Refund and Returns Policy, which forms part of these Terms. Please note that made-to-order items, including cloth cut to length, may not be returnable unless faulty. Nothing in these Terms affects your statutory rights.
8. Intellectual property
All content on the Site, including text, images, logos, articles and audio and video material, is owned by The GaDangme or its contributors and is protected by copyright and other rights. You may view and share content for personal, non-commercial use, but you may not reproduce, redistribute or use it commercially without our written permission.
9. Use of the Site
You agree to use the Site lawfully and not to misuse it, interfere with its operation, or attempt to gain unauthorised access to it. We may suspend or restrict access if we reasonably believe the Site is being misused.
10. Your information
We handle the personal information you provide in order to process your orders and respond to your enquiries. We do not sell your personal information. Any details you enter at checkout are used only to fulfil and support your order.
11. Limitation of liability
We provide the Site and our products with reasonable care and skill. To the extent permitted by law, we are not liable for indirect or consequential losses, or for losses that were not reasonably foreseeable at the time you placed your order. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded by law.
12. Events outside our control
We are not responsible for delays or failures to fulfil an order caused by events beyond our reasonable control, such as postal disruption, supplier failure, extreme weather or other circumstances outside our control. Where such an event occurs, we will contact you and, if appropriate, offer a refund.
13. Governing law
These Terms are governed by the laws of England and Wales, and any dispute relating to them will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
